This Master Photography & Media Services Agreement (“Agreement”) is entered into by and between Property Luxe Media (“Company,” “Photographer,” “we,” “us,” or “our”) and the client (“Client,” “you,” or “your”).
By booking, scheduling, or receiving services from Property Luxe Media, you agree to be legally bound by this Agreement.
ACCEPTANCE OF AGREEMENT
By using our services, you confirm that:
You are at least 18 years old
You have authority to enter into this agreement
You agree to all terms, conditions, and policies stated herein
You understand this is a legally binding contract
If you do not agree, you must not book or use our services.
SERVICES PROVIDED
Property Luxe Media provides professional visual media services including, but not limited to:
Real estate photography
Interior and exterior photography
Drone / aerial photography (FAA compliant where applicable)
Video walkthroughs and promotional videos
Twilight / virtual editing enhancements
Marketing content and branding media
Online gallery hosting and delivery services
Final deliverables, quantity, and scope are defined in the booking invoice or order confirmation.
DELIVERY OF MEDIA
All final edited media is delivered digitally via online gallery (including platforms such as HDPhotoHub or similar systems).
Standard delivery time is 24–72 hours unless otherwise specified.
Rush delivery may be available for additional fees.
RAW, unedited files are NOT included unless explicitly agreed in writing.
CLIENT RESPONSIBILITIES
Client agrees to:
Ensure property is ready for photography at scheduled time
Provide full access to all requested areas
Secure permissions from owners, tenants, or occupants
Remove personal items or clutter unless staging is requested
Ensure safe working conditions for photographer and equipment
Delays caused by unprepared properties may result in rescheduling or additional fees.
PRICING & PAYMENT TERMS
Full payment is due upon completion unless otherwise agreed in writing
Prices are subject to change without notice for future bookings
Additional services requested on-site may incur extra charges
Late or unpaid invoices may delay delivery of media
We reserve the right to refuse or pause services until payment is complete.
CANCELLATION POLICY
Cancellations must be made at least 24 hours before scheduled appointment
Same-day cancellations are subject to a $50 cancellation fee
No-shows or cancellations made after arrival may be charged up to 100% of the service fee
Deposits (if any) are non-refundable
Weather-related reschedules (for outdoor shoots) will be handled at no penalty.
OWNERSHIP & COPYRIGHT
All images, videos, and media created by Property Luxe Media remain the intellectual property of the Company.
Upon full payment:
Client receives a non-exclusive, non-transferable license to use media for marketing, listing, and promotional purposes related to the property only
Client may not sell, sublicense, or transfer media to third parties without written permission
Photographer retains the right to use media for portfolio, website, advertising, and marketing purposes
USE OF THIRD-PARTY PLATFORMS (HDPHOTOHUB)
Property Luxe Media may use third-party platforms such as HDPhotoHub for delivery, hosting, and distribution of media.
By using our services, you acknowledge that:
Your content may be uploaded, processed, and hosted on such platforms
You retain ownership of your original content
You grant necessary rights for hosting, delivery, display, and distribution of media
Platform terms (including HDPhotoHub Terms of Use) may also apply
CONTENT LICENSE
You grant Property Luxe Media a limited license to:
Store, edit, process, and deliver media
Use cloud-based systems and third-party tools
Share galleries with clients or authorized parties
Create marketing materials and portfolio content
This license is:
Non-exclusive
Worldwide
Royalty-free
Transferable
Sub-licensable (only for service delivery purposes)
CANCELLATION BY COMPANY
We reserve the right to cancel or reschedule services due to:
Weather conditions
Equipment failure
Safety risks
Emergency situations
Site access issues
In such cases, clients will be offered rescheduling or full refund if payment was made.
LIMITATION OF LIABILITY
To the maximum extent permitted by law, Property Luxe Media is not liable for:
Loss or corruption of digital files after delivery
Delays caused by third-party platforms or internet issues
Property condition, staging errors, or client-provided information
Indirect, incidental, or consequential damages
Total liability shall not exceed the amount paid for services.
INDEMNIFICATION
Client agrees to indemnify and hold harmless Property Luxe Media from any claims arising from:
Unauthorized property access
Misuse of delivered media
False or incomplete client information
Legal claims related to property or content ownership
ARBITRATION AGREEMENT (MANDATORY)
PLEASE READ CAREFULLY.
Any dispute arising from this Agreement shall be resolved exclusively through binding arbitration, not court litigation.
Arbitration will be conducted under rules of a recognized arbitration body (such as JAMS or AAA)
Each party waives the right to a jury trial
No class actions or group claims are permitted
Arbitration will take place in California, unless otherwise agreed
You may opt out of arbitration within 30 days by written notice to the Company.
CLASS ACTION WAIVER
You agree that any dispute must be brought in your individual capacity only and not as part of a class or representative action.
GOVERNING LAW
This Agreement shall be governed by the laws of the State of California, United States.
SEVERABILITY
If any section of this Agreement is found unenforceable, the remaining sections will remain valid and enforceable.
ENTIRE AGREEMENT
This Agreement, along with any invoice or booking confirmation, represents the entire understanding between the parties and supersedes all prior agreements.
