By accessing our website or booking our services, you agree to be legally bound by the terms below.
PART 1 — TERMS OF SERVICE
1. ACCEPTANCE OF TERMS
By using our website, booking services, or receiving media from Property Luxe Media, you confirm that:
You are at least 18 years old
You have authority to enter into this agreement
You agree to all terms outlined in this document
If you do not agree, you may not use our services.
2. SERVICES PROVIDED
Property Luxe Media provides professional media services including:
Real estate photography
Drone / aerial photography
Video walkthroughs
Interior and exterior photography
Marketing and branding content
Digital image delivery services
Final deliverables are defined in your booking confirmation or invoice.
3. DELIVERY OF MEDIA
Media is delivered digitally via online gallery (including platforms such as HDPhotoHub or similar systems)
Standard delivery time is 24–72 hours unless otherwise stated
RAW files are not included unless agreed in writing
Rush delivery may incur additional fees
4. PAYMENT TERMS
Full payment is required before or upon delivery unless otherwise agreed
Prices are subject to change for future bookings
We reserve the right to withhold delivery until payment is complete
5. CANCELLATION POLICY
Cancellations must be made at least 24 hours in advance
Same-day cancellation fee: $50
No-shows may be charged up to 100% of service cost
Deposits (if any) are non-refundable
6. CLIENT RESPONSIBILITIES
Clients agree to:
Provide access to the property on time
Ensure property is ready for photography
Obtain permission for access if needed
Ensure safe working conditions
Delays or rescheduling due to unprepared sites may result in additional fees.
7. COPYRIGHT & USAGE RIGHTS
All media created by Property Luxe Media remains our intellectual property.
Upon full payment:
Client receives a non-exclusive license to use media for marketing and listing purposes only
Client may not resell, transfer, or redistribute media without written permission
Property Luxe Media may use media for portfolio, website, and marketing purposes
8. THIRD-PARTY PLATFORMS (HDPHOTOHUB)
We may use third-party platforms such as HDPhotoHub to:
Deliver images and videos
Host client galleries
Store and distribute media
You acknowledge that:
Your content may be processed by third-party systems
You retain ownership of your content
Platform terms may also apply
9. LIMITATION OF LIABILITY
We are not liable for:
Data loss after delivery
Third-party platform failures
Property conditions or client-provided information
Indirect or consequential damages
Maximum liability is limited to the amount paid for services.
10. INDEMNIFICATION
You agree to hold harmless Property Luxe Media from any claims arising from:
Misuse of delivered media
Unauthorized property access
False client information
Legal disputes related to property or content
11. ARBITRATION AGREEMENT
Any dispute arising from this Agreement will be resolved through binding arbitration, not court.
No class actions permitted
Jury trial is waived
Arbitration will take place in California unless otherwise agreed
You may opt out within 30 days of agreeing to these terms.
12. GOVERNING LAW
This Agreement is governed by the laws of the State of California, United States.
